Three complaints of Unfairness – two were accepted by G-d and one, totally dismissed, and the complainants punished!
This week we will read about :
וַתִּקְרַ֜בְנָה בְּנ֣וֹת צְלׇפְחָ֗ד בֶּן־חֵ֤פֶר בֶּן־גִּלְעָד֙ בֶּן־מָכִ֣יר בֶּן־מְנַשֶּׁ֔ה לְמִשְׁפְּחֹ֖ת מְנַשֶּׁ֣ה בֶן־יוֹסֵ֑ף וְאֵ֙לֶּה֙ שְׁמ֣וֹת בְּנֹתָ֔יו מַחְלָ֣ה נֹעָ֔ה וְחׇגְלָ֥ה וּמִלְכָּ֖ה וְתִרְצָֽה׃
The daughters of Zelophehad, of Manassite family—son of Hepher son of Gilead son of Machir son of Manasseh son of Joseph—came forward. The names of the daughters were Mahlah, Noah, Hoglah, Milcah, and Tirzah.
וַֽתַּעֲמֹ֜דְנָה לִפְנֵ֣י מֹשֶׁ֗ה וְלִפְנֵי֙ אֶלְעָזָ֣ר הַכֹּהֵ֔ן וְלִפְנֵ֥י הַנְּשִׂיאִ֖ם וְכׇל־הָעֵדָ֑ה פֶּ֥תַח אֹֽהֶל־מוֹעֵ֖ד לֵאמֹֽר׃
They stood before Moses, Eleazar the priest, the chieftains, and the whole assembly, at the entrance of the Tent of Meeting, and they said,
אָבִ֘ינוּ֮ מֵ֣ת בַּמִּדְבָּר֒ וְה֨וּא לֹא־הָיָ֜ה בְּת֣וֹךְ הָעֵדָ֗ה הַנּוֹעָדִ֛ים עַל־יְהֹוָ֖ה בַּעֲדַת־קֹ֑רַח כִּֽי־בְחֶטְא֣וֹ מֵ֔ת וּבָנִ֖ים לֹא־הָ֥יוּ לֽוֹ׃
“Our father died in the wilderness. He was not one of the faction, Korah’s faction, which banded together against יהוה, but died for his own sin; and he has left no sons.
לָ֣מָּה יִגָּרַ֤ע שֵׁם־אָבִ֙ינוּ֙ מִתּ֣וֹךְ מִשְׁפַּחְתּ֔וֹ כִּ֛י אֵ֥ין ל֖וֹ בֵּ֑ן תְּנָה־לָּ֣נוּ אֲחֻזָּ֔ה בְּת֖וֹךְ אֲחֵ֥י אָבִֽינוּ׃
Let not our father’s name be lost to his clan just because he had no son! Give us a holding among our father’s kinsmen!”

Moshe Rabeinu brought the matter before G-d, and Hashem said:
כֵּ֗ן בְּנ֣וֹת צְלׇפְחָד֮ דֹּבְרֹת֒ נָתֹ֨ן תִּתֵּ֤ן לָהֶם֙ אֲחֻזַּ֣ת נַחֲלָ֔ה בְּת֖וֹךְ אֲחֵ֣י אֲבִיהֶ֑ם וְהַֽעֲבַרְתָּ֛ אֶת־נַחֲלַ֥ת אֲבִיהֶ֖ן לָהֶֽן׃
“The plea of Zelophehad’s daughters is just: you should give them a hereditary holding among their father’s kinsmen; transfer their father’s share to them.
So – the argument of “unfairness” was accepted here.
Similarly, we read just a few weeks ago about a complaint made by those who were not allowed to participate in Korban Pesach, as they were impure (טמא) on the day of Erev Pesach. There also -Hashem accepts the plea and grants them a “second Pesach” (פסח שני) a month later.
Here again – the argument of “unfairness” is accepted.
However, in stark contrast, when Korach was complaining that he should be promoted because “all of us are (as) holy”, his complaint resulted in a major punishment for him and his followers. What’s the difference ?
There are of course many differences, namely that there was no nastiness and grudge in the case of the “daughters” and the “impure” people. But perhaps there is another point to consider;
When a person (or a group) feels they were not given the same opportunity as the rest of the community, this is a fair and justified feeling and we must address it. When, however, a person or a group just wants to be treated better than the mainstream community, as in the Korach case, it is fueled by bitterness and jealousy. This – has no justification and there is “no case”. We all have different jobs and missions in life. Recognizing it, this can assist us to have a pleasant life…
